Might Assisted Living and Residential Care regulations backfire?

residential-care-choices-kfNew San Francisco Chronicle article by Melody Gutierrez talks about more regulation to fix the Assisted Living and Residential Care Home industry.  While this is a good idea at first glance we need to be careful in asking for things that will reduce senior choice and care options.  If this raises the cost of care or forces low cost providers out of business while raising the quality for the few who can pay they might price our the majority of seniors who are now choosing to stay where they are and are currently choosing to be private pay and not going onto medicaid.     Plans for sweeping change at assisted-living homes Melody Gutierrez,  Monday, January 13, 2014 While this sounds like a great idea I wonder if there might be some unintended consequences to the low and middle income seniors that this is trying to help by forcing them out of their current low cost and acceptable minimum level care that they are choosing.  Remember, all seniors in any facility can choose to move to another facility since this is a private pay system.  No one has to stay with anyone care team.  Legislation that raises the bar and costs to provide the care too high might drastically reduce the care options for most seniors including the middle and low income seniors. I draw your attention to a quote from this interesting article. “With more than a dozen bills making up a residential-care-facility reform package – their costs not yet determined – advocates calling for greater transparency and accountability say they feel confident the money needed to fix the Department of Social ServicesCommunity Care Licensing Division will be there” I have bolded the “their costs not yet determined”.  Not only costs in dollar costs but cost when many low income providers are forced to close their door to the broader health care system. While increased regulations and quality control is a good idea society needs to be aware of the big potential negative risk of raising quality and costs for Assisted Living and Residential Care beyond the means of most people.  While it is easy to follow the ATT TV commercials advice that “more is better” the potential costs to that might be that low and middle income people cannot afford more staff, higher quality staff, which in turn will lead to all of those people begin cared for in nursing homes on the government cost. While we do need regulations to protect seniors we also need to be much smarter about what those regulations are and how they are enforced.  I can’t go into that now but I always fear regulators who are not doing the work right now and in most instances low cost providers are underrepresented in these decisions.  The risk to the industry and overall health care system is devastating.  If there are no low cost, chronic care, places for low and middle income people even if they are somehow less but it is a lower standard they can afford and choose then that might not be so bad compared to being forced to live in a nursing home on the government Medicaid program.  Now many of these low income people PAY PRIVATELY our of their social security and other very limited resources.  Taking away low income housing choices even if they are not as good by over regulation will affect the hospitals, nursing homes, and the entire health care system who will have many long stay patients they can’t place. New Assisted Living and presumably Residential Care Home Screening tool.

Just saw this new Assisted Living and Residential Care Home screening/rating tool and wanted to share it with you.  In general, the more tools you can read the more and more focused questions you can ask when you meet the entire care team you are hiring including the administrators, manages, and direct care teams. While this is a great resource it is important to note that it focuses on tangible items more than on the feelings and emotions that result in care.   We realize feelings, dedication, hand-on management vs delegated management are hard to “study” in a survey but we believe those are what care, senior care and assisted living are all about in the last chapter of life.  Beyond their self imposed certification one might ask to see the data of the facilities and questions they used to arrive at that conclusion to get a more transparent and useful picture of the process they followed. How Do Las Vegas Families Evaluate Assisted Living Options for mom and Dad? From what we can tell and they divulge they base their reviews on Inspection data, ratings from local experts and reviews from residents and their families which then turned into an internal rating.  It would be nice to see more transparency of the weights, values and quantification of each item in their scale and the ones that they elected not to consider to better know how they arrived at the rating. value-code-principles Other things to consider or inquire if they considered. Of course we don’t know if the top rated places are subscribers to a related service are influenced by an advertising package on their site http://www.seniorhomes.com/ as is commonly the case in most forms of advertising.  We also don’t know what other care options they considered like home care, private case managers, residential care homes, smaller group or residential care homes or if they just looked at Assisted living facilities.  Did they use the definition of “Assisted Living” used by the state of Nevada or their own definition of Assisted Living?  Any of these “resources” are just that a small part of the picture that you can use when you visit each place and start to meet and know the administration and staff you are hiring to provide the Assisted Living, physical and emotional care.  It really is who is doing the work and management more than the care setting label, the referral source recommendation,  that should be your focus. We don’t know the administrator to resident ratio.  The administrator is the captain of the ship and a captain who supervises a bigger crew will likely have less contact with the staff to share their expertise.  While delegated management works in less personal care it is not as good when people, human emotion and feelings are involved.  Relationships require interpersonal time. We concede that it is very difficult for any “study” to begin to accurately access the interaction of management with their own care teams.  A good analogy of the role of the administrator would be the quarterback of a football team.  If the quarterback praises the line and the defense the team is generally stronger.  The same is true in Senior Care and Assisted Living.  Coordination of the care team both manages and direct care staff is essential to providing the most care and caring possible.  You can see how the managers interact with and value their staff when you meet them and take a tour with them and that is time well spent to get the more care for your private pay dollars.

We believe following our plan of meeting the managers and care team will help you feel socially and emotionally how much and who cares and save you money.  It is up to each senior and family to know who they are getting before they spend $30,000-$50,000 per year for care.  Make time to meet the entire care team and use these tools as a guide for the questions to ask.  What you are looking for is not the yes / no answer, or check in the box, but you are looking for the passion, dedication, and interaction of the administrator with their own team and residents while they answer your questions on the tour.  Relationships are about the process and passion and go way beyond yes/ no answers or checks in a column on any free care setting search too. Most of all, everyone needs to understand the senior care is a service and you need to meet the entire care team in all cases to compare the care, caring and sense of dedication to each resident and their own staff that is felt in any care setting.  These tools just help you remember to ask basic questions.  What you are looking for is the passion, dedication, availability of the management to meet you before you move in to start to get an idea of who will be managing and then providing the direct care you are buying now and for the last chapter of life of your loved on.  The people you are hiring matter.  Take the time to meet them and if they are too busy to meet you then you need to consider that before you decide to move in. How do you think Doctors Feel?  Questions to ask yourself.

Do you think doctors will be thinking about doing more, providing more continuity of care, building stronger relationships, take extra time to listen and assist in navigating the increasingly complex health care system or might they react differently? How have doctors reacted for the last Decade?  I have observed they have quit  private patient centered practice and taken jobs as institutional, or hospital controlled employees.  Is that what you observed? Do you think Assisted Living, and any care home will have an easier time getting medications, refills, follow up for you, and the patients they offer protective supervision for? Did you know that all doctors get paid exactly same for a 99215 or complex office visit?  That is right, if they spend one hour, or two hours and if they make lots of extra phone calls, if they answer the phone at night for you, they get the exact same pay from Medicare as the clinic doctor you do not know, have little hope of ever seeing again, and who might have not investigated your full story as completely as someone who you have an longer term relationship with. Health Care is more of a unknown “Service” or “Product” than other services or products.  Did you know that based on the Medicare CPT Code payment system all doctors are “the same”?  The CPT code system pays all doctors exactly the same for a 99215 no matter what they do, or how much extra they do. The terms of “% “are very misleading.  For Example, Medicaid  as primary coverage (Not Medicare) pays 100% of a doctor visit,  but they only pay 10 dollars for that doctor visit.  100% of $10 = $10.   For advertising purposes 100% sounds much better.  Likewise, what a doctor is doing, or could do, are largely unknown to most.  How many feel confident they know what one doctor does compared to another doctor and how that is cost effective for their private pay dollars?  Indeed, patients and now many doctors may have widely varied descriptions of what they could do and why it is cost effective for a senior and their family to spend private funds on that. 25% pay cut or new price for complex visit and all follow up until the next visit – $108 dollars. Doctors 99215 office visit.  One might ask what does a visit mean?  The following are just a few very general, things you may not think that are part of providing this service to you. Keeping/storing your records for a  5-7 year period and being responsible to retrieve them in a timely manor. Once they are “your Patient” even for one visit, the doctor is responsible to answer phone calls from patients, families,  Assisted Living, Residential Care Homes, Nursing Homes, and other care settings regarding their care including refill of medications.  Recall, the doctor only gets his 108 dollars if you visit him,  if you do not visit him and he refills medications on the phone then that is “included” in the 108 dollar visit he got on the last visit. Do you know that it is not required for Doctors to have Malpractice insurance and that 20-30% of out patient doctors may not have it?   How does that affect you or the care they are providing to you?  Doctor,  Hair Stylist, DVD Player Hair Stylist Visit

and style cost?  $50 -100.  What type of risks and long term commitment does she assume with her one hair cut visit? Does she keep records? What are the overhead costs to a Hair Stylist visit and how do those compare to to the overhead costs of a Doctor’s visit? DVD Player at Best BuyHow much do you pay for a DVD Player at Best Buy?  50-100?  How much service do you really expect if it breaks?  What type of customer service do you practically expect to get when it breaks or does not work?  A basic policy of bring it back within 30 days and we will refund your money and that is it?

How do you determine what services, amount of personal attention is important to you?  Questions you might ask.

What “assistance” do you get from any care setting?  What is “Assistance”? Does it include medically related care?  Does the management have any medical care experience; do they “need” any medical care experience?  What do you need and want and how do you define Assistance, Assisted Living, and Assisted Senior Living? The examples above are intended to show us that health care is a service, and like all services it depends highly on the individual people providing it.  We need to meet all of the people involved: management, owner, administrator, caregivers, medication technicians, and doctors if there is a house doctor to know what we are getting.  While we will still may not know it all,  by meeting the individuals in the team, we are much better able to decide on the value for our private care dollars.

Impact on Senior Care and All Senior Care Settings.

How does all of this affect Senior Care, and most importantly,  Care for seniors who are really sick, have multiple chronic diseases, and are likely to need assistance.  This will further reduce continuity of care by further pushing doctors out of medicine.  Some doctors who are unable to do anything else will just accept the new roll as a salaried employee/ doctor or the institution.  We believe that all people who get a salary will start to behave more like employees than old fashioned doctors.  The respected role of “Doctor” is changing and it is up to both doctors and patients to reevaluate what type of care they want and in what type of care setting they get it. Do residents and families choose a Big, Institutions with hundreds of residents or do they choose smaller care settings where you know the owner, administrator, staff and they all know you are another choice.  Finally, do not under estimate knowing and working with one doctor  when you are older, and  have many care needs and health concerns.   Continuity of the Care is the care.  In all cases, the care team including the doctor,  in each setting big or small, will determine the value you are getting for this very expensive item of Senior Care.  Senior care costs more than a new car every year and is a product most do not know as well as a car.

http://www.medscape.com/viewarticle/776955?src=nl_newsalert They may be pushing the Medicare cut back one year.  Now Doctors can just expect that cut next year.  They have one more year to plan their escape from Medicare.  Or Doctors, Patients, and Society can embrace Continuity of Care especially for the frail Elderly and those living in an Assisted Care Setting. One must wonder how these constant changes and proposed “fixes” to the payment system without addressing the care system are suppose to help care and caring?  It is unclear that any one has changed their relative value for Continuity of Care which we believe is essential to get and provide High Quality Care.    But only time will tell if it helps continuity of care and care or not. Health Care is about Continuity of Care and relationships.  Be cautious not to apply the six sigma standard of assessing business efficiency, and quality control when looking for health care services. Assisted Living Fire News Article.

Assisted Living Fire-News Article. This is a good example of an small personal Assisted Living Home in North Carolina.  Notice the picture of the single family residence.  However, many Big, Less Personal, Facilities, Hotels, or Institution also describe their Assisted Living Services as being Home Like.  The confusion and multiple definitions of the phrase Assisted Living require each senior and family to be cautious when assuming what the phase actually means.

Seeing is believing. Compare an Assisted Living Facility, or big institution with a small, personal, Home. We encourage all to follow Our Golden Rule-Meet the ENTIRE care giving staff from the Administrator, Owner, down to the Direct Care Providers. The more continuity of care the better, more caring, and less impersonal and assembly line the care is likely to be. Health Care, Assisted Living are services and require a relationship among the resident and persons providing that service to begin to expect caring to go with the physical care. What would these people do in case of emergency? The staff matter.  When you need something remember that is whey you need the skills.  Do not get the cheapest, least skilled people, you need skilled people as well as caring day to day providers especially when new, unique or emergent issues arise. Discussion of “The Importance of Assisted Living” 10/19/12

 “The importance of Assisted Living” Article that ran in wakeupnv.com.

While their message appears clear we feel that the meaning of some of the words can be misleading to many who might define the words differently.  When some one says “Available” you assume it is always and easily available.  Most people assume it is what you need and want.  However, the amount, type and degree of assistance available in many Assisted Living Facilities and any Senior Care Setting might not be as “Available” as the sales lady, the marketer, would indicate.  All care settings say we have caregivers, we have an administrator, we have doctors who come in, etc.  Few introduce you to the direct care team so you can decide how motivated they appear to spend time with you.    We use “Available”  and other key words in the article to spur discussion and review for each reader to consider what the author may mean  and the care setting might mean when they use words. Continuity of care and knowing who is providing the direct care at all levels is essential.  Who is Available?  When, where, and for how long?  Do they stay with you through thick and thin?  Visit you when you are out of your home or Assisted Living small studio room  in a hospital.

Review and Comment on the Article The Importance of Assisted Living Posted July 6th, 2012 by Joseph Stevenson.   INTRODUCTION              

This article is an example of a sales type of publication for Assisted Living Facilities.  While it does provide some general comments on Assisted Living, many of the words and ideas may be miss interpreted by those looking for Assisted Care, Assistance and personal care.   The goal of this discussion is to bring attention to some ideas, phrases, and words that might be miss interpreted by many readers.  Clarifying these words will help the reader better understand what they want and need in a care setting. This exercise will help to raise awareness to the interpersonal, people, part of assistance and care.   While it is hard to describe people, feelings, caring, character and responsibility, it is very important to strongly consider these things, instead of focusing on the physical plant, or the hotel style “service” of doing your laundry out and housekeeping.  Look not only at the care you want today but also at the care you will increasingly need in the future before you choose a low care alternative today.  Choosing a care setting with more care today will help you feel your best today and will improve the continuity of care and care you receive for the rest of your life.    If you choose the lower continuity of care options today it is likely you will be forced to accept less care when you need it in the future or to move at a time when you are less able to adapt to the changed care setting. We have re- written each paragraph of the Assisted living Article word for word and followed it with our comments on what is stated in the paragraph.

What are the two worlds he is talking about in line one?  It is implied in this statement that all of ones’ care needs can be met in an Assisted Living Facility.  Of course, maintaining independence is the “best world”, no matter what the setting.   Unfortunately, when most people consider Assisted Living they are already in need of some amount “care” or assistance.  The reality is that as you age, your care needs and the amount of assistance you need to function will increase.  Which is why, it is not the structural facility that is truly important, but it is the system of caregiving and coordination of care that is offered at a facility that is the most crucial factor.   It is the ease and reliability of receiving care you need when it is needed.

 These communities grant their residents with the independence they require with the knowledge that care services as well as person care availed to them anytime they require them.  These communities are aimed at offering the inhabitants with assistance in doing their basic activities.

This, in fact, is not entirely true.  Generally, Assisted Living facilities are geared to independent people who want a hotel type environment and have very minimal care needs.  They offer levels of extra assistance for personal care, like bathing and dressing, at an extra cost and the assistance needs to be scheduled or planned for in advance.  After the scheduled assistance is provided, the resident is largely on their own.   If you need help in-between the scheduled times, you have to be able to go somewhere and ask for help. Even then you might not get the help you need right away. There may not be someone available to assist you at the time you need them.   If you are independent enough to search someone out to assist you, then you probably do not have a high need for personal care.  For people who do have a need for assistance with personal care, then it would be much more difficult to search someone out and actually receive the assisted care you need.  For example, a resident with incontinence ideally would require a under garment or brief change every 2 to 3 hours to prevent skin breakdown and infections.  This type of personal care assistance is difficult to schedule in advance and can become very expensive as the number of interactions and assistance with personal care increase.    Often when people move in they are largely independent and is not until the need for more personal care arises, that they can actually see what is available, from whom, and when. It is very difficult to know in advance when you will need assistance.   Residential Care Homes offer an alternative type of care and setting in which the service and personal care is offered in more of a family like/home setting with assistance and supervision 24 hrs. a day, on an as needed basis.  The care is more of a friend or mother standing by type of care wince the building is smaller and the staff is constantly around the residents.  This is what we call Family-Style care.   The cost of residential care homes are usually inclusive of all services and care provided.   Assisted Living Facilities tend to offer A La Cart Care, at an additional price, where the care is provided according to the pre -arranged schedule.

These activities include dressing, grooming and bathing.  Other states also let these communities to provide medication assistance.  Here, complex medical services are not provided.  This distinguishes them from majority of the nursing homes.

Some Assisted Living Facilities do provide a basic level of medication management at an extra cost, with only one or two trained and certified medication techs.  In general, residents go to the medication room to get mediations so that the one med tech is in the med room in case someone wants an as needed medication. At times Medications are dispensed at meal times.  When the one Med Tech goes out to find a resident in the big facility the medication room is often times left unstaffed making it hard for the other residents to get medications.   With only one or two med techs for 50 to 100 residents, it may be difficult to locate the med tech when you need them.  Consider the size and complexity of the building, the number of floors and wings of the building. It can be a very large area to cover when looking for someone.  For more independent people that system works fine, but as you need more help that service might be harder for disabled, older, persons to utilize.  In residential Care homes, usually all of the caregivers are trained to give medications.  With fewer total residents, it is easy to see that access to the med tech and getting your medications is likely to be easier especially if you are not totally independent and unable to hunt down the med tech.

They always range from stand-alone homes to being one level of support center.  The environment is made to be attractive to both the potential clients and their people.  A friendly and home-like environment is normally availed.  The apartment elegance typically included a studio and one bedroom designs.

Assisted Living Facilities are not stand alone homes.   They usually offer studio or 1 bedroom apartments in an enormous building with 50 to 150 residents.  This does provide highly functional, independent residents with the privacy accorded with ones’ own living space.  On the other hand, it also may contribute to isolation and loneliness for residents who are not as independent and functional.  In contrast, Residential Care Homes provide care in a residential home that has a real family like feel, where there can be a higher level of supervision and interaction.  The staff or caregivers are usually trained in many disciplines, including medication management.  Also, the ratio of administrators, med techs and caregivers to residents is much higher in Residential Care Homes which means it is likely will have better access to the more skilled people in the care team.  For Example, if there is one administrator overseeing  50-150 residents in a large, multi-floor Assisted Living Facility, Compared to one administrator for 10 or fewer residents in a smaller Residential Care Home it is more likely the administrator in the smaller  Residential Care Home will know your name and see you on a regular basis.   The interaction and contact with the administrator is important because the administrator is the boss, the person responsible for coordinating the staff and ensuring the staff are trained to provide the care.  With a smaller resident to administrator/staff ratio the administrator is more likely to have hands on approach which leads to better continuity of care and personal interaction from the administrator and the staff they train or supervise.

A number of the clients to these communities are the old with chronic health issues.  This is why they are in dire need of assistance.  When they are assisted in preforming their daily activities, they are left with minimum responsibilities to do.

As stated earlier, Assisted Living Facilities are geared to more independent seniors, offering minimal assistance with personal care at an extra cost.  Often Assisted Living facilities are not set up provided higher levels of assistance that one may need as their chronic health issues worsen. Assisted living often has a limited staff of 2-3 caregivers serving 50 or more residents.  Covering such a large building, often with two floors and different wings, is a significant task to supervise.  In order for 3 caregivers to provide assistance to 50 residents, each care giver must assist approximately 16 residents.  Therefore, the caregivers have limited time to spend with each resident and are put on a tight schedule to meet the scheduled tasks.   Unfortunately, caregivers may just complete the task of a shower or dressing,   to save time and stay on schedule.   In many cases, it would be a bigger benefit for the resident if the caregivers encouraged  the residents to do  the things they are able to for themselves, even if it takes longer  like  buttoning there shirt.   Most seniors prefer to do it themselves and they take as long as need to do it.  The residents usually don’t have a high need to do it quickly.  The senior has all day and wants to fill the day up with productive things like doing their own personal care.  It is easy to see why staff /caregivers need to go quickly, but for seniors may feel more empowered, more in control, if the caregiver had taken he time to let the resident do more for themselves.The notion of providing assistance with daily activities for a resident and thus, leaving them minimal responsibility for their own care causes pause.   It is during this time of increasing need and decreasing function that senior residents want to maintain as much control over their own care and do as much care as they can for themselves.  If they want assistance they want to ask for and direct it.  It is important for caregivers to encourage seniors to participate in their own care, even if it takes them longer.  Allowing seniors to remain in control and participate in their own care might be a better goal than doing the task for them to save on time and stay on schedule.Clearly seniors want the responsibility and suggesting it is somehow better to take the responsibility away from them is somewhat concerning for this writer.

In such kind of places, meal provision are offered at least three times a day.  Housekeeping and laundry are also done for the clients.  Some provide swimming pool, fitness center, post office, beauty salon as well as transportation.  Others organize events, trips and activities that the dwellers can participate in.

Meal preparation, Housekeeping and Laundry services are hotel style services and are not what most consider as “care”. We believe that “care” and “Assistance” are highly interpersonal, people related services, and are quite different from the less personal housekeeping and Laundry Services.

Assisted living should let the inhabitants gracefully grow old.  This is so since the necessary support is easily accessible or if not, they have the responsibility of contacting other care offering agencies. This keeps the inhabitants in the society as the level of support rises.  The additional payment is thus paid on top of the regular monthly rent.

The important thing to note here is that in an assisted living environment, it may be difficult to grow old gracefully if you have medical problems or chronic conditions.  Be wary of places that outsource care to other agencies or say “if we can’t do it, we can get an outside agency to offer the care you need.”   This is an enormous additional cost to the resident.  In addition, delegating the responsibility of providing care does not support the idea of continuity of care. Personal commitment and responsibility of Facility and Residential Care Home owners, administrator and staff is essential to a frail aging senior with many medical problems.

In Sum, when considering an alternate care setting, like Assisted Living, there are many factors to consider.   It is important to follow the Golden Rule, meet the people who will do the direct care.  Assess how confident you are that the owners, administrator, med techs and staff want to do the work and provide the care.    Just because the sales lady said the staff will do the work does not make it true.  If the caregiver, administrator, doctor are easily accessible and take the time have discussions with you before you move in, it is a good indicator they are more personally invested providing the care and assistance.  If it is hard to meet and speak to all the people in the care team before you move in, it is likely it will be difficult to speak to these people when the need arises.  We believe commitments made by the individual are generally honored more than commitments of your time and efforts made by a sales lady on your behalf.  Meet the individuals who provide the direct care including administrator, med techs, caregivers, owner and others.
